Crestline Amateur Radio Tower Appeal Hearing Results

The hearing on the 120 ft. tower (next to Harry Sharder's) finally began at 5:00 PM 12/17/99. The arguments come down to the interpretation of the zoning code. The owners of the tower property said they were in a residential zone and therefore an amateur tower was permitted as an accessory use. The PMPO and the County staff argued that the property was in a residential zone but the property in question was not residential because it had been granted a Major Use permit for a 35 ft. commercial radio tower making that the principal use. Therefore an amateur tower would not be permitted as an accessory use.

The planning commission agreed with our position. they voted 7 to 0 to support our interpretation of the zoning code. There will not be any additional towers built on the site. Thanks to all of those who made the trip to San Diego for the Hearing and turned your green slips I am sure they helped the commissioners to make the right decision.
